The Public Rights Project (“PRP,” “we” or “us”) is committed to the right to privacy, including ensuring that individuals can exercise appropriate controls over their personal information. In this Privacy Policy, we explain how we collect, use, disclose, or otherwise process personal information about you when you access or use our websites and other online services (collectively, “Site”) that link to this Privacy Policy or interact with us offline. Your use of our site and interactions with us offline are subject to this Privacy Policy. We may update this Privacy Policy from time to time, as will be reflected in the “Last revised date” at the top of this Privacy Policy and, in some cases, we may provide you with additional notice (such as by adding a statement to our website homepage or by sending you a notification). We encourage you to review this Privacy Policy whenever you access or use the Site or otherwise interact with us to make sure that you stay informed about our information practices and the choices available to you.

Who we are
As a nonpartisan 501(c)(3) nonprofit organization, PRP helps local government officials fight for civil rights. We do this by building their capacity to protect and advance civil rights, convening and connecting them on issues of civil rights, and providing legal representation to governments to help them win in court on behalf of their residents. 1. Collection of Personal Information
PRP collects and stewards your personal information through a variety of methods. This section
outlines what information we collect and how we collect it.

Information you provide directly to us
We collect information you provide directly to us. We collect personal information when you sign up to receive newsletters, request information, fill out a form, sign up for an event, create an account, make a donation, communicate with us via third party social media sites or the Site, request support, send us an email, or otherwise communicate with us. The types of information we may collect includes your name, contact information (such as email address, postal address, and phone number), credit card and other payment information (which may be collected directly by a third-party processor), media you provide, and any other information you choose to provide. If you make a donation or purchase, we may collect information about the transaction, such as the donation amount, how you donated, and date and location of the transaction.

Automatically collected information
PRP and our authorized third parties may use technologies to automatically receive and record information when you interact with us online. These technologies allow PRP to improve our Site, to create a better experience for our users, and to protect against fraud. When you access or use our Site, we may automatically collect information about you, including:

  • Log and usage information: We collect information related to your access to and use of the
    Site, including the type of browser you use, browser user agent string, app version, access
    times, pages viewed, your IP address, and the page you visited before navigating to our Site.
  • Device information: We collect information about the computer or mobile device you use to
    access our Site, including the hardware model, operating system and version, unique device
    identifiers, and mobile network information.
  • Location information: We may derive the approximate location of your device, such as from
    your IP address.
  • Information collected by cookies and similar tracking technologies: We (and our service providers) use different technologies to collect information, including cookies and web beacons. Cookies are small data files stored on your hard drive or in your device’s memory that help us improve our Site and your experience, see which areas and features of our Site are popular, and count visits. Web beacons (also known as “pixel tags” or “clear GIFs”) are electronic images that may be used in our Site or emails to help deliver cookies, count visits, and to help us understand usage and program effectiveness. This information may be used by PRP and others to, among other things, analyze and track data, determine the popularity of certain content, deliver advertising and content targeted to your interests on our Site and other websites, and better understand your online activity.

Information we collect from other sources
We and our service providers may also obtain information about you from other sources and combine that with information we collect about you on our Site. We acquire this information to learn more about you — including how best to engage with you — and to identify people like you that may be interested in hearing from PRP. We do not collect or otherwise process sensitive personal information, as the term is defined under applicable privacy laws.

2. Use of information
PRP collects your personal information to further our mission through our advocacy and organizing, litigation, and fundraising programs. In addition, we aim to use only the information that is specific and necessary for the PRP processing purposes we collected it for. In the last 12 months, we have collected the following categories of personal information for the following purposes:

  • To whom we disclose personal information

We may use the information we collect to:

  • Provide, maintain, support, and improve our Site;
  • Provide and deliver the information you request, process donations, and send you related information, including confirmations and receipts;
  • Respond to your emails, comments, questions, and requests and otherwise contact you about your participation with PRP and the use of the Site;
  • Communicate with you about our work, such as sending you information to keep you informed about various issues, events, activities, and fellowship opportunities, and provide news and information we think will be of interest to you (see below for information about how to opt out of these communications at any time);
  • To solicit donations and support for work, issues, and organizations that we support and to connect you with others in our network;
  • Monitor and analyze trends, usage, and activities in connection with our Site;
  • Personalize the Site and provide advertisements, content, or features based on your preferences, interests, and browsing and online activities;
  • Detect, investigate, and prevent fraudulent transactions and other illegal activities and protect the rights and property of PRP and others; and
  • Carry out any other purpose described to you at the time the information was collected.

3. Third-party disclosure of personal information
We or our service providers may disclose your personal information as follows or as otherwise
described in this Privacy Policy:

  • With vendors, service providers, and consultants who need access to such information to
    carry out work on our behalf;
  • With organizations, groups, or causes that we believe have similar missions;
  • To file any legally required reports;
  • In response to a request for information if we believe disclosure is in accordance with, or required by, any applicable law or legal process, including lawful requests by public authorities to meet national security or law enforcement requirements;
  • When we believe in good faith that we are lawfully authorized or required to do so or that doing so is reasonably necessary or appropriate to comply with the law or legal processes or respond to lawful requests, claims, or legal authorities, including responding to lawful subpoenas, warrants, or court orders;
  • If we believe your actions are inconsistent with the spirit or language of our user agreements or policies, or to protect the rights, property, and safety of Public Rights Project, its employees, volunteers, constituents, or others;
  • In connection with, or during negotiations of, any reorganization or formation of a new committee or successor organization, asset sale or transfer, financing or lending transaction, or in any other situation where personal information may be disclosed or transferred as one of the assets of Public Rights Project; and
  • With your consent or at your direction.

We may also disclose aggregated or de-identified information that cannot reasonably be used by
those third parties to identify you.

We do not sell or share for cross-contextual behavioral advertising purposes your personal information.

4. Children
PRP does not knowingly collect, sell, or share for cross-contextual behavioral advertising purposes personal information of individuals under the age of 16. If you are under the age of 16, please do not use this Site or submit any personal information through this Site. If you have a reason to believe that an individual under the age of 16 has provided personal information to PRP through this Site, please contact us at info@publicrightsproject.org and we will look to delete that information from our databases.

5. How we protect your information
We have in place technical and organizational measures which are designed to protect the personal information we collect about you from unauthorized, improper or unlawful access, use, disclosure, alteration, or destruction consistent with applicable data protection laws.

6. How long we keep your personal information
We retain your personal information for as long as reasonably necessary and proportionate to achieve the purposes and uses set out in this Privacy Policy, as authorized by law, and to meet legal, taxation, accounting, risk management or business requirements. Different retention periods apply to different types of records and data. For example, any payment information collected as part of a donation or other financial transaction will be retained for a period of 7 years from the time of the transaction.

7. Links to other websites and social sharing features
This Privacy Policy applies only to this Site. The Site may contain links to other websites. For example, we may link to third-party sites to facilitate donations. Any personal information you provide on such linked pages is provided directly to that third party and is subject to that third party’s privacy policy and not this privacy policy. We encourage you to learn about their privacy and security practices and policies before providing them with personal information. For example, users of this Site may be directed to use Mighty Networks for a variety of reasons including training for fellowships. Mighty Networks is not part of PRP and your interactions with Mighty Networks is subject to a separate privacy policy.

The Site may offer social sharing features and other integrated tools (such as the Facebook “Like” button, which lets you share actions you take on our Site with other media, and vice versa). Your use of such features enables the sharing of information with your friends or the public, depending on your privacy settings for the relevant social media site. For more information about the purpose and scope of data collection and processing in connection with social sharing features, please visit the privacy policies of the entities that provide these features.

8. Transfer of information to the U.S.
PRP is based, and the Site is hosted, in the United States and is intended for, and directed to, users in the United States. If you are accessing the Site from any other region with laws or regulations governing personal information collection, use, and disclosure that differ from United States laws, please be advised that through your continued use of the Site, which is governed by United States law, this Privacy Policy, and our terms of use, you are transferring your personal information to the United States and you consent to that transfer.

9. What you can do with respect to your personal information

Choices for personal information
PRP offers you several choices in relation to the personal information we collect about you.
Depending on your jurisdiction, you may have a legal right to one or more of these choices. The
choices PRP offers include:

  1. Opting out: You have the choice to opt out of certain types of data processing activities.
    a. Promotional communications: You may opt out of receiving promotional emails or text messages from PRP by following the instructions in those emails or text messages. If you opt out, we may still send you non-promotional emails, such as those about your account or our ongoing business relations.
    b. Mobile push notifications/alerts: With your consent, we may send promotional and non-promotional push notifications or alerts to your mobile device. You can deactivate these messages at any time by changing the notification settings on your mobile device.
  2. Correcting what we have: You have the choice to correct the personal information we have about you.
  3. Deleting what we have: You have the choice to request that we delete the personal information we have about you, except information that is required or permitted to be kept in compliance with applicable law and obligations. If any personal information cannot be deleted, we will notify you when the request is complete. For users that register on our website (if available), you may see, edit, or delete your personal information at any time (except that you cannot change your username). However, note that we may retain certain information as required by law or for legitimate business purposes. We may also retain cached or archived copies of information about you for a certain period of time.
  4. Obtaining a copy of the personal information we have about you: If you have an account on the Site, or have left comments, you may request to receive an exported file of the data we hold about you by emailing us at info@publicrightsproject.org. You may submit a data choice request by emailing us at info@publicrightsproject.org. When you or an authorized agent on your behalf make a request, we will confirm your identity. We may contact you for more information to verify your identity beyond what is included in your initial request. Information collected to verify your identity will never be used for any other purpose than to verify your identity to fulfill your request. To preserve privacy and further equity, we are committed to not using biometrics, Social Security numbers, or commercial credit bureau information as part of our identity verification process.
